2. Policy Direction

Context

2.1 Subsection 29(1) of the National Defence Act (NDA) provides that a CAF member who has been aggrieved by any decision, act or omission in the administration of the affairs of the CAF for which no other process for redress is provided under the NDA is entitled to submit a grievance.

Policy Statement

2.2 The CAF is committed to ensuring that every CAF member who has been aggrieved:

  1. has the opportunity to exercise their right to submit a grievance; and
  2. receives a well-explained, timely and impartial determination of their grievance.

Requirements

2.3 The Canadian Armed Forces Grievance System (CAFGS) must ensure that:

  1. all grievances are processed as efficiently and expeditiously as possible;
  2. a CAF member is not penalized for submitting a grievance; and
  3. assistance is made available to a CAF member in the preparation of a grievance.

3. Consequences

Consequences for Non-Compliance

3.1 Non-compliance with this DAOD may have consequences for both the DND and the CAF as institutions, and for CAF members as individuals. Suspected non-compliance may be investigated. The nature and severity of the consequences resulting from actual non-compliance will be commensurate with the circumstances of the non-compliance.

  • act under section 29.11 of the NDA as the final authority (FA) in the grievance process; and
  • delegate under subsection 29.14(1) of the NDA.
VCDS
  • oversee the CAFGS.
DGCFGA
  • direct the actions required to ensure the effectiveness and efficiency of the grievance process; and
  • exercise powers, duties or functions delegated by the CDS as the FA in the grievance process.

  • act under QR&O subparagraph 7.14(1)(b), Officers Who May Act as Initial Authority in Respect of Grievance, as the initial authority (IA) in respect of a grievance if responsible to deal with the matter that is the subject of the grievance.

  • act under QR&O subparagraph 7.14(1)(a) as the IA in respect of a grievance if the CO can grant the redress sought.
